Kakinada: BJP State spokesperson Yarlagadda Ram Kumar and party senior leader and member of the Kakinada district voter list revision training committee Duvvuri Subrahmanyam said demands by opposition leaders to register sedition cases and initiate criminal proceedings against the Chief Election Commissioner reflected their lack of legal and political understanding.
Addressing the media at the BJP district office here, they said Section 16 of the Chief Election Commissioner and Other Election Commissioners Act, 2023 provides protection to the Chief Election Commissioner and Election Commissioners from civil and criminal proceedings for acts, things or words done, committed or spoken in the course of discharging their official duties. The provision states that no court shall entertain or continue such proceedings in respect of such official acts.
They also criticised opposition leaders, particularly those from the Congress, for questioning the 2023 law relating to the appointment of the Election Commissioners. They alleged that the Congress had itself amended laws in the past to overcome Supreme Court judgments and cited the Shah Bano case of 1986 as an example. The BJP leaders also questioned the appointment of PJ Thomas as Central Vigilance Commissioner in 2010, referring to the controversy surrounding his earlier prosecution in the palm oil import case in Kerala. BJP District General Secretary Kundala Sai Kumar Yadav was also present at the press conference.
